Hello
Your lawyer answers as follows:
Pursuant to Point k, Clause 1, Article 3 of Circular No. 111/2013 / TT-BTC stipulates tax-exempt incomes, specifically as follows:
- Retirement pensions paid by the Social Insurance Fund in accordance with the Law on Social Insurance;
- Pension is received monthly from the Voluntary Pension Fund.
- Individuals living and working in Vietnam are exempt from tax on pensions paid from abroad.
Therefore, if you live in Vietnam and have a pension from abroad, you do not have to pay personal income tax, so you do not need to validate your residence certificate in Vietnam to avoid paying taxes; you need to prove your retirement income stream is okay;
For the income outside the pension, you must pay income tax for that amount, when you pay tax in the Netherlands you keep the payment documents to prove in Vietnam when there is a request for personal income tax finalization;
The tax authorities in Vietnam do not confirm your residency because they do not have this function; to confirm residency in Vietnam by the police agency being the agency;
